Blaycation Travel – Booking Terms & Conditions
1. INTRODUCTION & DEFINITIONS
a. Welcome to Blaycation Travel. These Booking Terms & Conditions (the “Agreement”) govern the relationship between you (the “Client”) and Blaycation Travel (“we,” “us,” or “our”) with respect to any travel services booked through us. By submitting a Booking Request, you acknowledge that you have read, understood, and agreed to be bound by this Agreement.
b. If you are a travel agent or tour operator (a “Travel Representative”) booking services for an end client, you agree to these Terms both personally and on behalf of your client and confirm that (i) you have shared these Terms with your client and verified their review, and (ii) you are authorized to bind them to this Agreement.
c. The “Services” covered under this Agreement may include, without limitation, the design of a customized travel package (“Package”), the submission and processing of a Booking Request, the creation of a full itinerary (“Itinerary”), the arrangement of services through third-party suppliers such as hotels, guides, and transportation providers (“Suppliers”), and any other services we provide in connection with your trip (“Trip”).
d. By using our Services, you confirm that you are of legal age and have the capacity to enter into this Agreement.
2. USE OF SERVICES
a. You agree to use the Services only for legitimate bookings, either for yourself or for another person on whose behalf you are legally authorized to act. You confirm that all information provided will be accurate and complete and that you have read and understood the applicable terms and conditions.
b. We reserve the right to deny access to our Services at our discretion for any reason, including suspected misuse.
c. While on your Trip, you may book additional services directly with Suppliers, such as spa treatments or excursions. These “Ancillary Services” are governed by the Supplier’s own terms and may require separate waivers. You are responsible for reviewing and complying with all applicable Supplier rules and policies.
3. BOOKING PROCESS
a. You may submit a Booking Request via email. We will provide a preliminary itinerary outline for review.
b. No booking is confirmed until we receive your approval of the final itinerary and payment has been made in accordance with our payment terms.
c. Prices are quoted in USD, EUR, or CAD and are valid only for the date shown on the proposal or invoice. All prices are subject to change based on exchange rates, supplier pricing, and availability.
d. Special requests such as dietary restrictions, room preferences, or accessibility needs must be communicated at the time of booking. We will make every effort to accommodate these requests, but they cannot be guaranteed unless confirmed in writing.
e. Any changes made after confirmation may result in additional fees from Blaycation Travel and/or the relevant Suppliers.
4. PAYMENT TERMS
a. A deposit (typically 20–30% of the total cost) is required to secure your booking. The remaining balance is due no later than 45 days before departure. Late payment may result in cancellation and forfeiture of deposits.
b. We accept payments by wire transfer and major credit cards (Visa, Mastercard, American Express). Additional facilitation fees may apply depending on the destination and complexity of services booked.
c. Certain services such as cruises, flights, or event tickets may require full prepayment and may be non-refundable.
d. Failure to pay within the specified timeline may lead to cancellation of services without refund.
5. CANCELLATIONS & REFUNDS
If you cancel your trip, cancellation fees will apply as follows:
More than 45 days before departure: 20% of the total cost. Between 31 and 45 days: 60% of the total cost. Between 14 and 30 days: 80% of the total cost. Within 14 days: 100% of the total cost.
Additional Supplier-specific cancellation policies may apply. These will be communicated to you at the time of booking.
If Blaycation Travel cancels your trip due to force majeure or unforeseen circumstances, we will provide an alternative itinerary or a credit toward future travel. Refunds will be evaluated case by case.
6. CLIENT RESPONSIBILITIES
a. You are responsible for obtaining and carrying valid travel documentation, including passports, visas, and vaccination certificates. We are not liable for denied boarding or entry due to invalid or missing documentation.
b. We strongly recommend that you purchase comprehensive travel insurance to cover trip cancellations, medical emergencies, and other unforeseen events.
c. You agree to behave respectfully and responsibly during your trip. Any unlawful, inappropriate, or disruptive behavior may result in removal from the itinerary without refund.
d. We are not responsible for any lost, stolen, or damaged personal belongings. Any claims should be made directly through your insurance provider.
e. You are liable for any damages to accommodations or Supplier property caused by your actions. You agree to cover any costs incurred as a result.
7. ITINERARY CHANGES & UNFORESEEN CIRCUMSTANCES
While we do our best to deliver your itinerary as planned, changes may occur due to weather, local conditions, or Supplier operations. In such cases, we will provide a suitable alternative of equal or greater value.
8. COMPLAINTS & DISPUTES
a. If you experience an issue during your trip, notify us immediately so we can attempt to resolve it on the ground.
b. Formal complaints must be submitted within 14 days of your return. We will review all concerns in good faith and attempt to resolve them through dialogue. If necessary, mediation or arbitration may be used. Canadian law, specifically the law of the Province of Nova Scotia, shall govern all disputes.
9. LIMITATION OF LIABILITY
a. Blaycation Travel serves as an intermediary between you and third-party Suppliers. We are not responsible for the acts or omissions of these Suppliers.
b. We are not liable for any loss, delay, injury, or damage resulting from force majeure, government actions, civil unrest, Supplier insolvency, or other events beyond our control.
c. Our liability for any claim arising from your booking shall not exceed the total amount you paid to us for the affected Services.
10. GOVERNING LAW & JURISDICTION
This Agreement is governed by the laws of the Province of Nova Scotia, Canada. Any legal action arising from this Agreement must be filed in the appropriate courts of Nova Scotia.
